NEW YORK -- The owner of a training and sports medicine clinic sued Major League Baseball and several of its employees Thursday, claiming they caused the companys social media accounts to be illegally hacked during the sports Biogenesis investigation.Neiman Nix, a 29th-round draft pick of the Cincinnati Reds in 1998, and his DNA Sports Performance Lab, claimed an MLB investigator misrepresented herself as law enforcement and MLB intimidated the companys clients and hacked accounts on YouTube, Facebook and PayPal. The allegations are similar to those filed in a suit two years ago that was dismissed.Vincent White, Nixs new lawyer, said former MLB investigator Ed Dominguez is cooperating and will testify MLB employees illegally gained access to electronic accounts of individuals they investigated through various exploits and phishing schemes. We believe these tactics may have extended to players, team staff and ownership groups. The suit admits Nix and his company used Bioidentical Insulin like Growth Factor (IGF-1), which is derived from elk antlers and is on baseballs list of banned substances.MLB called the suit frivolous.Mr. Whites purported source for this lawsuit is a disgruntled former MLB employee who was terminated for cause, it said in a statement. Mr. White has been threatening to file this lawsuit for months in an attempt to coerce MLB into paying his client. MLB considers the allegations in this lawsuit, including the allegations relating to the hacking of DNA Sport Labs social media accounts, to be sanctionable under New York law.Nix and his lab sued MLB, Major League Baseball Properties, Major League Baseball Enterprises, then Commissioner Bud Selig and MLB investigator Awilda Santana on Feb. 18, 2014, in Florida state court, alleging defamation, slander and tortious interference. MLB senior vice president of investigations Dan Mullin and senior director of investigations George Hanna also were defendants. The case was dismissed that Nov. 6 by Circuit Judge John W. Thornton, who said the plaintiffs and their lawyers never served the suit on the defendants and failed to show up for scheduled case management conferences.Thornton wrote this courts patience is at an end and then added, referring to the time it took for the case: TWO HUNDRED SIXTY ONE (261) to perfect service in this case. At no times has a summons in this case ever been issued. He also said the plaintiffs and their lawyers failed to show up for scheduled case management conferences. At that time the case wasnt ripe, White said. Frankly, the cooperation of the investigators we have today makes or breaks this matter. The new suit, filed in U.S. District Court in Manhattan, claims tortious interference under Florida and New York law and lists MLB, Selig, new commissioner Rob Manfred and Santana as defendants along with MLB vice president of information security Neil Boland.Mullin and Hannah were terminated by MLB two years ago.White did not identify others in addition to Dominguez who were cooperating.Mr. Dominguez is the most outspoken but we expect other investigators, based on our communications with them, to also be testifying, he said.White also represents former Mets closer Jenrry Mejia, who was banned for life in February following his third positive drug test. The Biogenesis investigation led to the suspensions of more than a dozen players, including Yankees star Alex Rodriguez.Hydro Flask Billig . - Baltimore Ravens quarterback Joe Flacco is not a fan of his teams use of the wildcat formation, saying "it makes you look like a high school offence. We didnt get early stops that we needed and they got back into the game. But then we were able to take a deep breath, get some stops and get some baskets.Georgetown (1-2) led by 17 after a superb first half, capped by Pryors running 3-pointer at the buzzer. The Ducks (2-2) swarmed their way back, using pressure defense to create turnovers and easy baskets in transition.Unlike their loss to Maryland last week, the Hoyas weathered the Duck storm and will advance to the second round against No. 16 Wisconsin.LJ Peak added 17 points and hit two free throws with 2.7 seconds left to seal Georgetowns victory. Our guys did a good job not getting dejected and refocusing, Hoyas coach John Thompson III said.Oregon struggled the entire first half despite having leader Dillon Brooks in the lineup for the first time this season. The Ducks clawed their way back behind pressure defense, though didnt have enough to finish it off.Payton Pritchard led Oregon with 18 points. Brooks had eight points, including a long 3-pointer with 3.8 seconds left to get the Ducks within 2.As great a comeback as it was, we werent tough enough to finish it, Oregon coach Dana Altman said.Brooks didnt play in Oregons first three games while recovering from offseason foot surgery and Altman said he would limit the preseason All-Americans minutes in Maui.Brooks entered Mondays game about five minutes in with the Ducks struggling. He didnt do much to help them.Oregon needded six minutes to hit its first field goal and kept missing shots, going 7 for 29 from the floor in the first half.dddddddddddd Brooks was 0 for 3 and did not score. The Hoyas had their own problems early, but rallied behind Pryor. Perimeter shooting is a concern; Oregon went 4 for 17 from the 3-point arc after hitting 3 of 21 in a loss to Baylor.POLL IMPLICATIONSDepending on what happens the next two days in Maui, the Ducks could be looking at a precipitous fall in the poll, possibly even out of it altogether.BROOKS RETURNAltman stuck to his plan to limited Brooks minutes, only giving him 13 against the Hoyas. Brooks was superb on the defensive end, particularly on the press in the second half, and finishing 3 of 8 shooting. We held him to the 10 to 15 minutes that we thought wed play him, Altman said. And he was mad because he wanted to play more.UP NEXTGeorgetown will face No. 16 Wisconsin in Tuesdays winners bracket.Oregon faces Tennessee in the losers bracket on Tuesday. ' ' '
